Terms of Service

By using the ConfirmOk website www.confirmok.com and the ConfirmOk services (collectively, the "Service"), the Account Owner, Subscriber, and Care Group (collectively, "Customer" or "you") hereby agree to these terms and conditions. The business is operating under ConfirmOk LLC.
1. Emergencies
ConfirmOk should not be used in the event of any emergency. For Customers in the USA, dial 9-1-1 in an emergency. Customers outside the USA should dial their national emergency number. The Service and its infrastructure are not warranted for use in life-threatening or emergency situations where failure of the Service can cause injury, harm, death, property damage, or other grave problems.
2. Authorization
Account Owner represents and warrants that they have obtained the authorization of Care Givers and Loved Ones to subscribe to the Service, to create, maintain, use, and transmit personal and other information regarding Loved Ones to Care Givers and Account Owner, and to enter into these terms and conditions on behalf of Care Givers and Loved Ones.
3. Limitation of Liability
Customer agrees to hold harmless and indemnify ConfirmOk and its affiliates from any claim, demand, loss, liability, or expenses arising from the use of the Service. ConfirmOk shall not be liable for any damages, including direct, indirect, incidental, consequential, special, or other damages arising from the use of the Service.
4. No Warranty
The Service is provided "as is" and "as available" without any warranties, express or implied, including but not limited to implied warranties of merchantability, title, non-infringement, and fitness for a particular purpose.
5. Network Security
Customer acknowledges that the infrastructure used to provide the Service may experience interruptions, errors, or omissions and that data transmitted through the infrastructure is not guaranteed to be secure.
6. Payment Terms & Refunds
The Service charge applies to the Loved One only. There is no charge to be a member of a Care Group. Service is billed in advance on a monthly or annual basis and is non-refundable. ConfirmOk reserves the right to refuse or cancel service at any time.
7. Modifications to the Service and Prices
ConfirmOk reserves the right to modify or discontinue the Service at any time with or without notice. Prices are subject to change upon 30 days' notice.
8. Entire Agreement
These terms and conditions constitute the entire agreement between ConfirmOk and Customer.
9. Mutual Respect and Privacy of Communications
Customer agrees to approach ConfirmOk privately with any grievances and not to make public communications that disparage ConfirmOk. ConfirmOk agrees to the reciprocal of this clause.
10. Termination
ConfirmOk may terminate or suspend service if Customer violates these terms. Customer may cancel their account at any time.
11. Successors and Assigns
All disclaimers of warranty and liability shall be binding upon Customer and their successors and assigns.
12. Amendment, Severability, and Assignment
ConfirmOk reserves the right to alter these terms at any time. Any changes will be effective immediately upon posting. If any provision is found to be unlawful or unenforceable, the remaining provisions shall remain in effect.
13. Governing Law and Jurisdiction
These terms and conditions are governed by the laws of the State of California. Customer agrees to submit to the exclusive jurisdiction of the state and federal courts located in California.

ConfirmOk offers the option for users to receive SMS notifications.
